Terms of Service

1. Acceptance

By creating an account or using the AxiomField service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. What the Service is

AxiomField is a business-to-business platform that transforms voice recordings and site photos captured by field technicians into structured compliance reports, using speech-to-text and large-language-model artificial intelligence.

3. AI is advisory only

Compliance scores, risk flags, PPE assessments, damage detections, and any other AI-generated output on this platform are advisory recommendations, not authoritative safety, engineering, legal, or regulatory determinations. AI can and will make mistakes, miss defects, and produce false positives or false negatives.

Supervisors, safety officers, and other qualified personnel must independently verify AI outputs before acting on them. AxiomField is not a substitute for on-site inspection, licensed engineering judgment, WHS assessments, or applicable regulatory processes.

4. Recording consent (voice + images)

When you record audio or take photos using the Service, you represent and warrant that:

• You have obtained all consents required under the applicable Australian state or territory recording laws (which vary — see e.g. Surveillance Devices Act legislation in each jurisdiction).
• Everyone whose voice or likeness is captured has been informed of the recording and its purpose, and has consented to the recording and to processing by AI.
• You will not upload material that infringes any third party's privacy, contractual, or intellectual property rights.

You are solely responsible for compliance with these laws. AxiomField does not obtain consent on your behalf.

5. Subscriptions, billing, cancellation

Paid plans are billed monthly or annually in advance via Stripe. Prices are shown in AUD ex GST; Stripe adds 10% GST at checkout for Australian customers. You can cancel at any time via the Manage subscription button in the app; cancellation stops future billing periods but does not entitle you to a refund of the current billing period, except where required by the Australian Consumer Law.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) which cannot lawfully be excluded.

6. Limitation of liability

To the maximum extent permitted by law, AxiomField's aggregate liability for all claims arising out of or relating to the Service is limited to the fees paid by you in the twelve (12) months preceding the event giving rise to the claim. AxiomField is not liable for indirect, consequential, incidental, punitive, or exemplary damages, including loss of profits, loss of data, or business interruption.

7. Acceptable use

You will not use the Service to record without consent, to attempt to derive the underlying AI model weights, to circumvent access controls, to upload unlawful content, or to reverse engineer the platform.

8. Termination

We may suspend or terminate access for material breach of these Terms. On termination, your access to reports and data will be preserved for 30 days to allow export, then permanently deleted.

9. Governing law

These Terms are governed by the laws of New South Wales, Australia. Disputes are subject to the exclusive jurisdiction of the courts of New South Wales.
